What to Expect at the Next TREC Meeting

TREC advisory committees have made several recommendations for rule changes and adoption that the Commissioners will discuss and potentially propose during the TREC Meeting on February 13. Get the highlights of what will be considered, including inspection report rule changes, proposed SAE requirements, and changes that affect broker responsibility and oversight of sales agents' brokerage activity.

Are You Using the Right Forms?

The revised forms adopted by the Texas Real Estate Commission last November are mandatory for use as of February 1, with the exception the revised "Notice to Prospective Buyer [ [link removed] ] "(TREC 57-0) form, which will remain a voluntary use form. What Consumers Should Know About Texas Property Inspections

Homebuyers and sellers in Texas should be cautious about hiring inspectors who offer to do walkthrough, abbreviated inspections that don't follow TREC's Real Estate Inspector Standards of Practice (SOPs) and don't come with a completed TREC "Property Inspection Report Form" (REI 7-6), regardless of any additional report the inspector provides.

Texas inspectors are required to follow SOPs and provide the TREC promulgated form, and not doing so could result in disciplinary action from TREC for the inspector and an incomplete, unusable inspection of a property for consumers.

CE Credit
 

Earn CE Credit for Attending the TREC Meeting In Person

Earn up to four hours of continuing education (CE) credit by attending the Texas Real Estate Commission Meeting on Monday, February 13, at 10 a.m. CT in Austin. Breaks called by the Commissioners during the meeting do not count toward CE credit, and you do not automatically earn four hours if the meeting is shorter than four hours. Make sure to sign in when you arrive to ensure you receive CE.

ESAC Recommends 30-Hour Real Estate Brokerage Course as Part of SAE Requirement and Updates to Property Management Course Outline

The Education Standards Advisory Committee (ESAC) met January 9 and appointed new leadership, discussed the revised property management course outline, and made recommendations for the Commission to propose an amendment to 535.55. Read more [ [link removed] ]

Unauthorized Practice of Law Working Group Recommends Dropping Rule Proposal Eliminating Use of Brokerage-Specific Forms Prepared by an Attorney

After reviewing hundreds of public comments, the Unauthorized Practice of Law Working Group recommended the Commission revert back to the current law for Section 537.11 (a)(4), which allows license holders to use brokerage forms prepared by an attorney when no mandatory TREC form exists as long as certain requirements are met. Read more [ [link removed] ]

Broker Responsibility Working Group: New and Revised Rules Up for Proposal, Recommendations for Identifying Brokerage Associations

The Broker Responsibility Working Group (BRWG) met January 11 and got updates from staff, discussed how to identify brokerage associations, and who should receive complaint notifications. Read more [ [link removed] ]

TREIC Recommends Commission Adopt Proposed Amendments to Inspection Report Form Rules

The Texas Real Estate Inspector Committee met in January and recommended the Commission propose rule changes related to instructor course credit for ride-along courses for CE, clarifying delivery deadlines for inspection reports, and that inspectors must document the reasons for checking multiple boxes on the report form.
