As of today, we've tracked 167 lawsuits filed in 2022 across 34 states. 101 of these lawsuits are currently active and ongoing. Of the active lawsuits, 42 seek to restrict access to voting.
Here are some updates from today.
The Pennsylvania Supreme Court ruled that counties cannot count undated mail-in ballots and wrongly dated mail-in ballots in this year’s midterm elections. Even though the court found that counting these ballots violates state law, the six justices were evenly divided on whether rejecting these ballots would violate federal law. [link removed]
A New York court rejected two Republican lawsuits seeking to strike down two absentee voting laws. [link removed]
Also in New York, the League of Women Voters of the Mid-Hudson Valley and others filed a lawsuit over the lack of a polling place on or near Vassar College’s campus. [link removed]
A federal court held a hearing this afternoon in a lawsuit seeking to immediately prohibit Clean Elections USA from monitoring drop boxes in Arizona. Get the full play-by-play here. [link removed]
Priorities USA, the Detroit/Downriver Chapter of A. Philip Randolph Institute and voters intervened to defend absentee voting in a GOP lawsuit challenging how absentee ballots are administered, returned and counted in Detroit, Michigan. [link removed]
As of Oct. 31, the seven Wyoming counties that planned to use drop boxes in the 2022 midterm elections have continued to do so, disregarding Interim Secretary of State Karl Allred's (R) suggestion to remove all drop boxes in the state. [link removed]
