As of today, Democracy Docket tracked 160 lawsuits filed in 2022 across 34 states. 97 of these lawsuits are currently active and ongoing. Of the active lawsuits, 40 seek to restrict access to voting.

Election Day is only 8 days away, but we are still awaiting crucial court rulings that could impact voting and elections this year. Here are the lawsuits we’re watching. [link removed]

Here are some updates from today.

On Friday, Oct. 28, Arizona Attorney General Mark Brnovich (R) issued an advisory opinion permitting counties to conduct hand count audits of ballots in this year’s elections. His advice contradicts guidance from Secretary of State Katie Hobbs (D). [link removed]

Today, the Arizona Alliance of Retired Americans and a Democratic voter filed a lawsuit against multiple county officials and election administrators in Cochise County, Arizona challenging the county’s plan to perform a hand count audit of all early ballots. [link removed]

The U.S. Department of Justice (DOJ) submitted a statement of interest in a federal lawsuit against several Arizona groups that have engaged in alleged voter intimidation. [link removed]

The U.S. Supreme Court denied a petition from Pennsylvania House Majority Leader Kerry Benninghoff (R) to review the state's legislative maps. Benninghoff first challenged the maps in the Pennsylvania Supreme Court, which upheld the districts. [link removed]

The Democratic Congressional Campaign Committee and Democratic Senatorial Campaign Committee filed a motion to intervene in a Republican lawsuit over the partisan affiliations of poll workers in Clark County, Nevada. The Democratic groups argue that Republicans are misapplying state law in the matter. [link removed]

On Friday, Oct. 28, the Wisconsin Elections Commission withdrew its absentee ballot spoiling guidance that permitted voters to ask election officials to spoil (meaning discard and disqualify) their returned absentee ballots and receive new ones if they change their minds or opt to vote in person instead.
