Evidence uncovered by the January 6 committee shows that Ginni Thomas, the
wife of Supreme Court Justice Clarence Thomas, was a central figure in
Trump’s attempt to overturn the 2020 presidential election.
She personally lobbied state legislators to approve fake electors. She
sent 29 text messages to White House Chief of Staff Mark Meadows in the
run-up to January 6, urging him to support efforts to overturn the
election.^1 She even attended the Stop the Steal rally on January 6 before
the attack on the U.S. Capitol.^2
And yet Clarence Thomas has refused to recuse himself from cases related
to the January 6 attack that could directly implicate his wife — even as
she faces a possible subpoena to force her to testify about her actions
around the January 6 insurrection.^3
The Thomases can get away with this only because the Supreme Court is the
only court in the land that doesn’t have a code of ethics requiring judges
to recuse themselves when facing a conflict of interest. That needs to
change right now. Tens of thousands of Demand Progress Action members have
already contacted Congress, and now we need to turn up the heat.

There’s simply no way the public can trust Justice Thomas to rule
impartially on any case related to the January 6 insurrection. In fact,
his ruling on another case shows that he won’t: he was the only justice to
dissent in the Supreme Court’s decision to reject Trump’s request to
withhold documents from the January 6 committee.^4
But this isn’t just about Justice Thomas.
The nine justices appointed for life to the Supreme Court make their own
rules and scorn transparency. They’ve helped make the judiciary the most
powerful and least accountable branch of government. They don’t have even
the most basic rules against conflicts of interest.
That’s why we’re pushing to pass the Judicial Ethics and Anti-Corruption
Act, which would require the Supreme Court to adopt a code of ethics,
prevent justices from owning stocks, and more.^5 It’s a long-overdue,
common-sense move toward restoring legitimacy to the court.
