The far-right Supreme Court supermajority just delivered a devastating blow to the environment.

Here’s what they did: In West Virginia v. EPA, the ultra-conservative wing of the Supreme Court ruled 6-3 to restrict the EPA's authority to regulate greenhouse gas emissions.

It’s an outrageous decision: Not only did the court invent a far-reaching new doctrine to address a case that lacked standing, it severely limited the ability of federal agencies to fight climate change and protect public health.

Here’s what we’re doing: Our team of over 188 lawyers is fighting back. We are working harder than ever to give the earth the best legal protection against negligence, greed, and pollution. We must ensure that the administration and Congress use every tool in their toolbox to combat the climate crisis.

Before the Supreme Court even released their opinion, Sam Sankar, our Senior Vice President of Programs, published an opinion essay in the New York Times.

Sadly, Sam was right. In its extreme decision in West Virginia v. EPA, this Supreme Court went out of its way to limit the EPA from regulating greenhouse gas emissions under the Clean Air Act. It ties the hands of government agencies attempting to prevent the most catastrophic outcomes of the climate crisis.

But here’s the good news: we’ve been preparing for this moment.

Although the Supreme Court’s ruling today feels like a devastating loss, our movement is growing and gaining strength. Over two-thirds of Americans want stronger environmental regulations. Your contributions allow us to bring more cases to courts across the country. Our litigation stops pollution, defends frontline communities, and protects the environment from fossil fuel corporations.

Using the Clean Air Act: We have secured stronger federal limits on harmful air pollutants such as ozone, soot, and mercury, saving thousands of lives and billions of dollars in health-related costs each year.
Using the Clean Water Act: We halted the Constitution Pipeline, a 124-mile gas pipeline that threatened water quality, wildlife, and public health.
Across the country: Earthjustice litigation has compelled coal-fired power plants to internalize the costs of their air, water, and waste pollution, which has contributed to decisions to shut down more than half of U.S. coal generation.
And in Congress: Our team of 24 policy experts is working to advance equitable climate policy, fix our fundamentally unjust system of pollution control, and protect biodiversity.
