Here’s what they did: In West Virginia v. EPA, the ultra-conservative wing of the Supreme Court ruled 6-3 to restrict the EPA's authority to regulate greenhouse gas emissions.
It’s an outrageous decision: Not only did the court invent a far-reaching new doctrine to address a case that lacked standing, it severely limited the ability of federal agencies to fight climate change and protect public health.

Before the Supreme Court even released their opinion, Sam Sankar, our Senior Vice President of Programs, published an opinion essay in the New York Times:
Sam Sankar: Some of the court's conservatives seem eager to asist polluting industries by undercutting the power of agencies to regulate in the public interest.
Sadly, Sam was right. In its extreme decision in West Virginia v. EPA, this Supreme Court went out of its way to limit the EPA from regulating greenhouse gas emissions under the Clean Air Act. It ties the hands of government agencies attempting to prevent the most catastrophic outcomes of the climate crisis.
But here’s the good news: we’ve been preparing for this moment.
Although the Supreme Court’s ruling today feels like a devastating loss, our movement is growing and gaining strength. Over two-thirds of Americans want stronger environmental regulations.
