Excerpt: The number of overstays in 2020 went up very slightly from 2019, as did the rate of overstays. This is bad news, considering that for half of the fiscal year international travel was drastically curtailed due to the pandemic and fewer visas were issued in the second half of the year.

The Biden administration’s stance in the MPP litigation appears to be “woe is me, if only Congress would give DHS enough money to meet its detention mandate.” Yet, the administration has apparently never even bothered to honor its other relevant mandate — to tell Congress how many resources it would need to do exactly that – which might be a sign that the administration doesn’t really want to honor its detention mandates.

It is long overdue for the Executive Branch to honor IIRIRA’s mandate that aliens placed into expedited removal who claim a fear of return be detained until removed or until the completion of immigration court proceedings. Taking this step would go a long way toward ending the reality of large numbers of inadmissible aliens skipping their hearings and remaining at large in the United States unlawfully.
