BREAKING: A Majority of Voters Oppose President Trump Filling the Supreme Court Vacancy, and A Plurality Want to Expand the Court!
President Trump and Senate Majority Leader Mitch McConnell are already working overtime to rush in a Supreme Court nominee — but brand new DFP polling ([link removed]) shows that voters want to wait until after the election to fill the seat. 53 percent of voters believe that just like Republicans blocked the approval of Merrick Garland, we should wait until after the election before Trump fills the seat, while 39 percent want him to fill the vacancy now.
We launched this poll immediately in response to the news of Justice Ruth Bader Ginsburg’s death, and we need to raise more money to keep these polls going into the field. Help us to keep up this critical polling work by donating to Data for Progress right now! ([link removed])

Our polling also found that if Biden wins, voters would oppose attempts by Trump to sneak in a Justice during the lame duck session. 51 percent of respondents believe that Biden should fill the vacancy if he wins this November, while 38 percent would want Trump to confirm a Justice during the lame duck session.
If Trump is indeed able to confirm a Justice, it would create a 6-3 partisan, conservative majority that could serve as a major roadblock for progressive legislation for decades. That’s why NY-17 Democratic nominee Mondaire Jones took to our blog ([link removed]) on Saturday to make the case for expanding the Supreme Court to 13 seats if Trump replaces Ruth Bader Ginsburg despite a Biden victory — and allowing Biden to fill those extra seats.
Our polling found something striking on this issue: a plurality of voters are on Jones’ side! We find that 40 percent of Americans would support Joe Biden adding new seats to the Supreme Court if he wins the election but Trump fills the Supreme Court vacancy. 39 percent oppose.
This polling is critical to opposing Trump’s efforts to destroy the Supreme Court, and building support for expanding the court with new Justices. The situation is urgent, and we need to keep the momentum up — help us continue fielding these polls by clicking here to donate to DFP now! ([link removed])
