Our polling also found that if Biden wins, voters would oppose attempts by Trump to sneak in a Justice during the lame duck session. 51 percent of respondents believe that Biden should fill the vacancy if he wins this November, while 38 percent would want Trump to confirm a Justice during the lame duck session.
If Trump is indeed able to confirm a Justice, it would create a 6-3 partisan, conservative majority that could serve as a major roadblock for progressive legislation for decades. Our polling found something striking on this issue: a plurality of voters are on Jones’ side! We find that 40 percent of Americans would support Joe Biden adding new seats to the Supreme Court if he wins the election but Trump fills the Supreme Court vacancy. 39 percent oppose.
