Trial Begins for Protect Education
This Friday marked the first day of the trial for the Protect Education Act — or Prop 212. A Maricopa County Superior Court judge heard arguments on whether voters should have the chance to consider Prop 212’s sweeping private school voucher reforms [[link removed]] this November. [[link removed]]
Although the Protect Education coalition turned in over 421,000 signatures in July, deep-pocketed special interests have issued a scorched-earth legal challenge that seeks to overturn as many signatures as possible in order to keep Prop 212 off the ballot. The lawsuit, backed by the ultra-right Goldwater Institute and Free Enterprise Club, seeks to invalidate signatures on the basis of circulator registration issues, notary stamp issues, duplication issues, and much more.
The court case will continue into next week, and Protect Education’s lawyers are ready to defend every signature collected!!! We feel confident that we turned in more than enough to qualify, and will keep you updated on the trial.

Prop. 145 Ballot Language Rejected
😡 Judge Rules against Prop 145 Ballot Description: In not-so-good news, a judge has ruled against Secretary of State Fontes’ ballot description for the deceptive Prop 145 [[link removed]] (which GOP lawmakers referred to the ballot as a fix for military families, but is actually a poison pill seeking to invalidate the Protect Education Act). Fontes’ language warned in the first line that a yes vote on Prop. 145 would invalidate Prop. 212 (Protect Education). Simple, right?

Guess again 🙄 Maricopa County Superior Judge David McDowell acknowledged that Prop. 145 nullifies any other measure in its entirety that affects those vouchers – but said that Fontes broke the law when his description said that approval of Prop. 145 would "nullify Proposition 212.''
The key, said McDowell, is Fontes is supposed to describe the effect of ballot measures on "existing law.'' And because Prop. 212 is not now existing law but simply a proposal, the judge said any reference to how Prop. 145 would affect it is illegal. "It may or may not become a law,'' McDowell wrote. "But that determination isn't made until all votes are cast.'' More to the point, he said, if Prop. 212 fails, it doesn't become law and, therefore, Prop. 145 has no effect on it.
🤞 Not the last word? McDowell ordered Fontes to recraft the description, this time leaving out any reference to Prop. 212. The new order, however, may not be the last word. Calli Jones, spokeswoman for Sec. Fontes, said he is weighing whether to seek Supreme Court review. "We stand by our decision to include the provision in the ballot language detailing the impact of a 'yes' vote on the citizen's initiative,'' Jones said.
