Today, 13 young Pennsylvanians are taking a powerful stand for their rights and their future by filing an appeal challenging the Department of Environmental Protection’s approval of the Homer City Redevelopment Project, which they argue violates their state constitutional rights to life, health, and safety, as well as the Pennsylvania Environmental Rights Amendment.
The appeal, McIntosh v. Department of Environmental Protection, ([link removed]) seeks to stop a permit that would turn the site of Pennsylvania’s former largest coal-fired power plant into the nation’s largest gas-fired facility, built solely to power a massive 3,200-acre data center.
If allowed to move forward, this single plant would emit more than 17.5 million tons of greenhouse gases every year, locking Pennsylvania into decades of dangerous fossil fuel pollution.
The plant’s emissions would:
* Release more greenhouse gases annually than some entire states.
* Increase Pennsylvania’s commercial emissions by 153.5%
The Commonwealth is prioritizing one unnecessary fossil fuel project over the health and safety of its citizens. This is what Pennsylvania youth are up against.
To protect their health, safety, and lives, the youth appellants are asking the court to:
* Vacate the Homer City permit and stop the project
* Ensure Pennsylvania’s government fulfills its constitutional duty to protect youth climate rights and public trust resources.
Across the Commonwealth, young people are already experiencing heatwaves, flooding, worsening air quality, and drought. Each additional ton of pollution worsens these harms, and the consequences fall on children who had no say in the decision.
Pennsylvania does not need this project. The state can meet its energy needs with cleaner, cheaper alternatives. Choosing more fossil fuel pollution over the health of children is an unconstitutional choice, not a necessity.
These 13 youth are refusing to sit back while their futures are on the line. Through this appeal, they are ensuring their home state fulfills its constitutional duty to protect public trust resources, secure a safe climate, and safeguard the wellbeing of current and future generations.
