**Then Accidentally Walks Free from Jail**

Back in April, a tourist jogging in downtown Dallas was punched in the face by a homeless man in broad daylight. The attacker, Kevin Dewayne Simmons, had a long rap sheet filled with violence, drug use, and untreated mental illness. He was arrested, denied a no-cash bond, and spent months in jail awaiting sentencing. In July, a judge finally sentenced him to probation and ordered him into a residential rehab facility. But the plan fell apart, because the jail let him go.

Due to a clerical error, Simmons’ case was mistakenly marked as dismissed. Instead of being transferred to treatment,

**he was quietly released.** [link removed] It wasn’t until days later that police spotted him near the West End and re-arrested him without incident. County officials blamed the mistake on “human error,” and the DA’s office admitted there’s no state funding for court-ordered residential treatment for misdemeanor cases. So the judge ordered a remedy that doesn’t even exist, and the system pretended it had done its job.

This would be bad enough on its own, but it’s part of a bigger pattern.
