Dear friend,

Yesterday, Rolling Stone published a powerful article by Earthjustice President Abigail Dillen about the Trump administration’s latest assault on our climate. They’re proposing to gut the EPA’s endangerment finding – the legal foundation for regulating greenhouse gas pollution.

In the article, she lays out in clear terms just what this means:

“President Donald Trump’s administration has officially put Americans on notice that it will be doing nothing to address climate change. Actually, worse than nothing, the Environmental Protection Agency also announced that it will soon be taking back everything it had done to date to address the biggest source of climate pollution in the country.”

But on our side there's legal precedent — and, thanks to supporters like you, a track record of prevailing at the highest court in the land:

“It is a point of pride at Earthjustice, where I am privileged to work, that we were part of the legal team that litigated Mass v. EPA, along with several subsequent cases concerning the EPA’s authority to regulate climate pollution under the Clean Air Act. Over time, the Supreme Court had several opportunities to backtrack, but it never did.

Instead, the court repeatedly affirmed the decision that our national clean air statute is capacious enough to address the biggest pollution threat ever.”

The fight ahead won’t be easy, but we’ve faced these battles before, and we’ve won. And with your support – we can win again.

Dear Friend,

Today, the Trump administration made the unprecedented decision to start the process of repealing the “endangerment finding” – the scientific and legal declaration that allows the government to regulate greenhouse gas emissions.

As climate change-fueled disasters wreak havoc on communities across the country, Trump’s Environmental Protection Agency is saying that it is not the responsibility of the government to do anything about the pollution that is causing climate change. The agency tasked with protecting people and the environment is just going to pretend that climate change isn’t a problem.

You don’t need to be a climate scientist to believe what your eyes are seeing: massive floods, droughts, wildfires, hurricanes and more are a regular occurrence now and will only continue to get worse the longer we delay our transition away from burning fossil fuels. It is not an exaggeration to say this decision will endanger the health and lives of millions of Americans.

What is the endangerment finding and why does it matter?

In 2009, faced with a trove of scientific research that links greenhouse gases to a warming, chaotic climate, the EPA made the scientific determination that greenhouse gases are air pollutants that endanger public health and welfare by driving climate change. This is called the endangerment finding.

The endangerment finding has served as a basis for rules limiting greenhouse gas emissions. It has played a critical role in limiting power plant emissions, vehicle emissions and methane emissions from oil and gas drilling. The repeal of the endangerment finding is a handout to corporate polluters who poison our water and our air.

What happens now?

Today’s proposed repeal of the endangerment finding will initiate a comment period, in which Earthjustice will participate. A final rule is expected before the end of the year.

Earthjustice was an integral part of a team that successfully defended the endangerment finding against fossil fuel industry challenges after its adoption. With your support, we will continue to play a role in the defense of public health and clean air.

Thank you for your continued partnership.
