One of Donald Trump’s first judicial nominees of his second presidency is
so extreme that he once called for bringing back literacy tests in order
to vote.

"are not a bad thing," Josh Divine argued in a 2010 college opinion piece"
Literacy tests were used in the United States between the 1800s and 1960s
to prevent immigrants, people of color, and low-income people from voting.
They went hand-in-hand with poll taxes to disenfranchise voters and keep
power in the hands of wealthy, white landowners.
Thankfully, these anti-democratic tests were outlawed by the Voting Rights
Act of 1965, but Trump nominee Josh Devine wrote in 2010 that states
should bring them back.
We can’t say we’re surprised: Divine previously clerked for right-wing
Supreme Court Justice Clarence Thomas and worked for Trump loyalist and
far-right Senator Josh Hawley.
But in a time when our fundamental rights and democracy are under attack,
we can’t afford to let someone who once supported literacy tests have a
lifetime term on the bench.
