One of Donald Trump’s first judicial nominees of his second presidency is so extreme that he once called for bringing back literacy tests in order to vote.
Literacy tests were used in the United States between the 1800s and 1960s to prevent immigrants, people of color, and low-income people from voting. They went hand-in-hand with poll taxes to disenfranchise voters and keep power in the hands of wealthy, white landowners.
Thankfully, these anti-democratic tests were outlawed by the Voting Rights Act of 1965, but Trump nominee Josh Devine wrote in 2010 that states should bring them back.
We can’t say we’re surprised: Divine previously clerked for right-wing Supreme Court Justice Clarence Thomas and worked for Trump loyalist and far-right Senator Josh Hawley.
But in a time when our fundamental rights and democracy are under attack, we can’t afford to let someone who once supported literacy tests have a lifetime term on the bench.
Trump already stacked the courts with right-wing loyalists during his first term — we can’t let him get away with it again.
