In the lead-up to the 2024 election, hundreds of election-related lawsuits brought across the country present a complex litigation landscape well before all ballots are cast and counted.
In a top 10 list [[link removed]] , Just Security identifies the most important of these hundreds of cases for their rule of law implications and to convey an overall sense of the election litigation landscape. At the top of their list, is our case regarding mail-in ballots.
While it’s disappointing that our motion for review was denied, the Pennsylvania Supreme Court still has not ruled on the merits of our argument that enforcing the handwritten date rule violates voters’ constitutional rights. We hope that, when the next case is before them on this issue, they’ll consider the important constitutional issue at stake.
Make no mistake: That day could and should come very soon. The next appeal raising this issue is already working its way up from the Philadelphia Court of Common Pleas.

The Election Law Blog also made a summary of top suits mentioning our organization. "The Pennsylvania Supreme Court has declined to step in and immediately decide issues related to mail-in ballots in the commonwealth with early voting already under way in the few weeks before the Nov. 5 election. The commonwealth’s highest court on Saturday night rejected a request by voting rights and left-leaning groups to stop counties from throwing out mail-in ballots that lack a handwritten date or have an incorrect date on the return envelope, citing earlier rulings pointing to the risk of confusing voters so close to the election."

“The Republican petitioners claim that some counties — including Bucks County, Centre County and Philadelphia — chose to count undated or wrongly dated mail-in ballots in the November 2024 general election. They argue this violates the state Supreme Court’s orders in two related [[link removed]] lawsuits [[link removed]] , which prohibited the counting of undated or wrongly dated mail-in ballots in the November election.”

The plaintiffs argue that this violates the Pennsylvania Supreme Court’s decision in a similar recent lawsuit, which prohibited undated or wrongly dated ballots from being counted in the general election.”
New York Judge Strikes Down State’s Voting Rights Act [[link removed]]
“On Thursday, a New York trial court judge struck down the state’s 2022 Voting Rights Act (NYVRA), which was created to make up for deficiencies in federal law following Congress’s 2021 failure to pass the John R. Lewis Voting Rights Act... Citing the 2023 U.S. Supreme Court ruling that determined race-based affirmative action in college admissions was unconstitutional, Vazquez-Doles wrote that the NYVRA similarly “provides enhanced rights” to protected classes, in violation of the Constitution. ”

In an election defined in part by a tsunami of litigation before polls even opened, few states saw as much legal haggling over which ballots should count as Pennsylvania... In at least four counties — Bucks, Philadelphia, Centre and Montgomery — local election officials are acting in open defiance of a ruling from the Pennsylvania Supreme Court that arrived weeks before the election. The court found that mail ballots that are missing the date on the outer envelope, or have the wrong date, cannot be counted for this election... The commissioners were advised that they were likely to be sued no matter how they ruled. “So we’re going to get sued either way, I’d rather be on the side of counting ballots than not counting them,” Mr. Harvie said.
