In our increasingly polarized climate, virtually all major policy issues are decided in the courts. In recent years, the Senate has confirmed lower court judges along strictly partisan lines, creating red-state judges and blue-state judges. This makes it easy for conservative activists looking to file court cases to block national legislation to "judge-shop", or handpick judges in high-stakes cases who will deliver their preferred outcome. This rising trend is straining the coherence of our federal system, pushing the judiciary and the country toward a constitutional crisis.
For our October special issue, Hassan Kanu wrote about how the courts have split so dramatically, and what this judicial crisis means for our democracy. Finding solutions might require looking entirely outside of the courts, towards a greater national consensus.
