** Fulton Superior Court Attempts to Overturn LIFE Act

Activist Judge orders that the state can no longer enforce the 2019 Living Infants Fairness and Equality Act (LIFE Act, a.k.a. Heartbeat Bill) that took effect in 2022. This ruling now allows for abortions to be preformed up to 20 weeks into a pregnancy.

** It’s An Election Year

A liberal, pro-abortion, activist judge has attempted to create a right to abortion out of whole cloth by finding it resides in the “penumbra” of actually enumerated rights.

From the AJC: “Fulton County Superior Judge Robert McBurney issued an order ([link removed]) Monday that said abortions must be regulated as they were before Georgia’s 2019 law took effect in July 2022 — meaning the procedure is again allowed up until about 22 weeks of pregnancy.”

Judge McBurney’s order sets the clock back to 2012 where abortions could be performed up to the 20th week of pregnancy or when the baby could feel pain under the Pain Capable Unborn Child Protection Act.

It’s not particularly surprising that Attorney General Chris Carr said the state plans to appeal. And rightly so.

What will be less surprising is when this election year decision is overturned on appeal.

Judge McBurney shows his true colors as a judicial activist by referencing “The Handmaid’s Tales” in his official opinion!
