It’s An Election Year
A liberal, pro-abortion, activist judge has attempted to create a right to abortion out of whole cloth by finding it resides in the “penumbra” of actually enumerated rights.
From the AJC: “Fulton County Superior Judge Robert McBurney issued an order Monday that said abortions must be regulated as they were before Georgia’s 2019 law took effect in July 2022 — meaning the procedure is again allowed up until about 22 weeks of pregnancy.”
Judge McBurney’s order sets the clock back to 2012 where abortions could be performed up to the 20th week of pregnancy or when the baby could feel pain under the Pain Capable Unborn Child Protection Act.
It’s not particularly surprising that Attorney General Chris Carr said the state plans to appeal. And rightly so.
What will be less surprising is when this election year decision is overturned on appeal.
