North Carolina elections board appeals decision in RFK Jr. ballot dispute case
* The North Carolina State Board of Elections appealed ([link removed]) a decision ordering them to reprint ballots to remove Robert F. Kennedy Jr. as a listed presidential candidate because it would further delay the start of absentee voting in the state.
* The federal deadline to send absentee ballots to voters in a presidential election is Sept. 21, but vendors have said reprinting ballots could take another 12 to 13 days, so despite their best efforts, the state may have to request a waiver to the deadline.
GOP targets tool in Washington county making it easier to cure ballots
* The Washington State Republican Party sued ([link removed]) King County for its use of an online tool allowing voters to fix errors on their ballot, claiming that votes "illegally cured" through the website led to the primary defeat of a GOP candidate for local office.
Republicans appeal two pro-voting Pennsylvania decisions
* On Friday, Washington County, along with the Republican National Committee (RNC) and Pennsylvania Republican Party, appealed ([link removed]) a decision to the Commonwealth Court that mandates ([link removed]) the county to inform voters of errors on their mail-in ballots and let them cast provisional votes at the polls in the upcoming election.
* On Sunday, Butler County, along with the RNC and Pennsylvania GOP, appealed ([link removed]) a decision to the state Supreme Court that requires ([link removed]) the county to count provisional ballots from voters who inadvertently submitted mail-in ballots without an inner secrecy envelope — known as “naked ballots.”
9th Circuit and state Supreme Courts will hear voting rights cases this week
* The 9th U.S. Circuit Court of Appeals is scheduled ([link removed]) to hear oral argument on Tuesday in the ongoing legal challenge against two of Arizona’s voter suppression laws. The lawsuit challenges several provisions, including a restrictive documentary proof of citizenship requirement for voters.
* The Wisconsin Supreme Court is set ([link removed]) to hear oral argument on Tuesday in a right-wing lawsuit that could impact the availability of early absentee voting sites in the city of Racine. Conservatives argue that these sites unfairly benefit Democrats.
* The Florida Supreme Court is slated ([link removed]) to hear oral argument on Thursday in a lawsuit challenging the state's congressional map. Pro-voting groups argue that the map, drawn by Gov. Ron DeSantis (R), illegally discriminates against Black voters.
Deep dive into new RNC lawsuits in crucial swing states
* Republicans have filed a handful of lawsuits in recent weeks targeting election administration in the key swing states of Michigan and North Carolina. In a new YouTube video, Marc and Democracy Docket’s Paige Moskowitz explain ([link removed]) the lawsuits and the GOP’s motivations for starting new legal battles so close to the election.
