The Biden administration recently enacted a new regulation on self-employed and independent workers: the Employee or Independent Contractor Classification Under the Fair Labor Standards Act ([link removed]) . The rule is as complicated as it sounds and many Americans don’t know about its quiet implementation. The new Biden new rescinds the Trump-era rule that made it easier for workers to be classified as independent contractors. Instead, it replaces it with a multifactor analysis test to determine whether a worker is an employee or an independent contractor.

The rule is already facing legal challenge.

The effects of this rule are frustrating. It disproportionately affects women, career professionals, stay-at-home moms, seniors, students, those with disabilities, and those who rely on side hustles to supplement their income.
