The Biden administration recently enacted a new regulation on self-employed and independent workers: the Employee or Independent Contractor Classification Under the Fair Labor Standards Act. The rule is as complicated as it sounds and many Americans don’t know about its quiet implementation. The new Biden new rescinds the Trump-era rule that made it easier for workers to be classified as independent contractors. Instead, it replaces it with a multifactor analysis test to determine whether a worker is an employee or an independent contractor.

The rule is already facing legal challenge. 

The effects of this rule are frustrating. It disproportionately affects women, career professionals, stay-at-home moms, seniors, students, those with disabilities, and those who rely on side hustles to supplement their income. 

It will be disastrous for freelancers, entrepreneurs, and small businesses nationwide. These are people who depend on flexibility.
