No one likes a backseat driver. Especially when that backseat driver is a federally mandated monitoring technology. But that is exactly what the National Highway Traffic Safety Administration (NHTSA) is looking to implement.
When Congress passed the Infrastructure Investment and Jobs Act <[link removed]> in 2021 they included a requirement that NHTSA develop regulations and standards to mandate that all new cars:
- Passively detect intoxication levels and disable the car, and;
- Passively detect and monitor “impaired” driving — monitoring you constantly, likely with cameras, sensors, and AI technology.
This technology restricts our agency as an Americans and and our presumption of innocence. While every death due to drunk driving is a completely avoidable tragedy, the government is a sledgehammer, not a precision instrument. It will do more harm than good.

The kinds of technologies the NHTSA is looking to implement will open a can of worms that will ruin your car. Under the considered regulations:
- Cars will become more expensive than they already are
- Imperfections will lead to false positives, endangering and inconveniencing you
- Your personal and digital privacy will be at risk from the monitoring technology
- You will be presumed guilty which is why you must be watched throughout your drive
