** Fair Courts Passed the NY Assembly! ([link removed])
------------------------------------------------------------
Fair Courts (A,3057 - Cruz / S.5826 - Kavanagh) is a critical bill ([link removed]) that ensures immigrant New Yorkers facing criminal charges get
* a clear notification that there could be an immigration impact;
* an alert about the right to advice from their attorneys; and
* a remedy when proper notification isn’t given by the court.
The bill moved out of the Senate Codes Committee earlier this month. We look forward to the Senate bringing it to the floor for a vote. The bill passed both houses of the legislature last year (as the Court Notification Bill) but was undermined by the Governor’s veto.

** Fighting Deportations based on Wrongful Convictions
------------------------------------------------------------
** Two longtime LPRs recently won their deportation cases after receiving post-conviction relief and litigation assistance with the help of IDP.
------------------------------------------------------------
IDP and partner organizations supported Mr. A-J- with an amicus brief ([link removed]) at the Ninth Circuit after his unlawful drug offenses were vacated. A longtime green card holder, he will not be able to remain at home with his family and apply for U.S. citizenship.
At the Second Circuit, the government refused to reopen Mr. C-’s removal proceedings after his unlawful convictions had been vacated. IDP, the National Immigrant Litigation Alliance, and Wilmer Hale (led by Alan Shoenfeld, IDP Advisory Board member), supported Neighborhood Defender Service of Harlem as they represented Mr. C-. After a Second Circuit appeal and amicus ([link removed]) were filed, the government reopened and terminated Mr. C-’s removal proceedings, restoring his green card holder status. He can now remain in his home city of New York.
** Continuing the fight!
------------------------------------------------------------
IDP recently filed two amicus ([link removed]) briefs ([link removed]) in Board of Immigration Appeals cases supporting immigrants whose convictions have been overturned. IDP would like to collaborate with practitioners fighting for immigrants whose convictions have been overturned. In March and April 2023, IDP and the Surveillance Resistance Lab hosted a two-part train the trainer series about ICE raids. The trainings gave an overview of how ICE operates. It lays out the ways ICE uses policing and surveillance tools to locates, target, and track noncitizens. The program provided KYR information in a variety of scenarios where people may encounter ICE. Over 300 people registered for the training and attendees came from all over the U.S. and beyond.
