From 2016-2020 Stephen Miller and then- President Trump issued asylum bans that were repeatedly found to be unlawful by a federal court, and as a candidate, President Biden, members of Congress, and the American public decried this kind of denial of access to asylum.
Now the Biden administration has proposed their own asylum ban, that will return asylum seekers to harm and possibly even death. It will disproportionately harm Black, brown, Indigenous, and LGBTQIA asylum seekers requesting safety at the U.S. southern border—who often cannot afford or access a visa to arrive in the U.S. by plane and instead are forced to trek across multiple countries to arrive at the U.S. border.

There have been at least 10,250 reports of murder, kidnapping, rape, torture, and other violent attacks against migrants and asylum seekers blocked in or expelled to Mexico due to Title 42 since the Biden administration took office.1
U.S. laws and treaties protect asylum seekers and prohibit their return to persecution and torture. Our laws also explicitly guard an asylum seeker’s right to seek protection regardless of how they arrive in the United States. The rule would unlawfully deny protection to asylum seekers and require them to seek asylum in countries that do not have functional asylum systems and where they may still be in harm’s way.
