You’ve probably heard the news by now. A Trump-appointed judge in Texas is hearing a federal case that could jeopardize access to Mifepristone — one of the two drugs prescribed for medication abortions.
His decision, expected any day now, is likely to be one of the most consequential rulings on abortion since the Supreme Court overturned Roe V. Wade last June.
One radical, right-wing, Trump-appointed judge is threatening to issue a national injunction that could revoke the FDA’s long-standing approval for Mifepristone. If he ends up doing so, it could temporarily take the medication off the market, even in states where abortion is otherwise legal.

Even with a decision still pending, we’re already seeing the ramifications of this case play out.
Earlier this month, Walgreens announced it will not dispense Mifepristone in 21 states — including states where abortion is still legal — after threats of legal action from Republican officials in those states. Other retail pharmacies like CVS are also considering following suit, despite previously announcing plans to carry the medication.
Still, even if Judge Kacsymaryk issues an injunction limiting access to Mifepristone, it’s important to note that it wouldn’t be the end of medication abortions.
Mifepristone is just one of two drugs used in a standard medication abortion. The second is Misoprostol, which although not as effective as the two-drug regimen, can still terminate a pregnancy when used alone.
Regardless, this case could set a dangerous precedent that would fundamentally destabilize the FDA regulatory system.
If extremist judges with no scientific or medical background can overturn the FDA’s approval of medication, then other medications under attack by the GOP — like puberty blockers and hormone treatments for trans people — could also be outlawed.
