NOTICE OF PUBLIC HEARING

BOARD OF ENVIRONMENTAL PROTECTION

APPEAL OF ROBERT BROWN d/b/a BROWN?S GULF of
DEPARTMENT OF ENVIRONMENTAL PROTECTION UNDERGROUND OIL STORAGE FACILITY ADMINISTRATIVE ORDER

On February 14, 2023, the Commissioner of the Department of Environmental Protection
(?Department?) issued to Robert Brown (d/b/a Brown?s Gulf in Wells) an Underground Oil Storage
Facility Administrative Order (?Commissioner?s Order?) pursuant to 38 M.R.S. ? 565-A (?the Oil
Storage Law?). The Commissioner?s Order requires, among other corrective actions, that Mr. Brown cease deliveries of oil to, and operation of, the underground oil storage facility used for the retail distribution of motor fuels located at 1584 Post Road in Wells, Maine. On February 27, 2023, Mr. Brown filed with the Board of Environmental Protection (?Board?) a timely appeal of the Commissioner?s Order.

The Oil Storage Law and Department rule Chapter 4, Rule Governing Hearings on Appeals of Certain Emergency or Administrative Commissioner Orders, (06-096 C.M.R. ch. 4) govern appeals of administrative orders issued by the Commissioner. The Oil Storage Law provides that the Board will hold a hearing on the appeal.

The Board will hold a hearing on Mr. Brown?s appeal on April 13, 2023, at the Augusta Civic Center, 76 Community Drive, Augusta, Maine 04330, beginning at 10:00 a.m.

HOW TO PARTICIPATE: Members of the public are invited to attend the hearing and offer testimony relevant to the appeal before the Board. Members of the public are not required to submit written testimony before the hearing, nor file petitions for leave to intervene, in order to testify. Members of the public may simply attend the hearing and give oral testimony. Unless otherwise extended by the hearing presiding officer, the record, and the opportunity to submit evidence to the Board for consideration in deciding the appeal, will close following all testimony offered at the hearing on April 13, 2023.
