A hearing in the case that could remove mifepristone from the market in every state – a medication used in over half of abortions in the U.S. – was held this Wednesday.

An extremist, anti-abortion judge – Matthew Kacsmaryk – was hand-selected by the anti-abortion groups who filed the suit with the goal of getting a ruling ordering the FDA to withdraw its approval of an extremely safe medication that has been used for decades.

Any fair judge would reject the attempt to use the court for their political purposes and would throw the case out. In fact, in the hearing the lawyers who brought this lawsuit were forced to admit that there was no case in the history of the U.S. where a judge had ordered a drug off the market. But unfortunately, it seems from this week's hearing that Judge Kacsmaryk is open to the claims raised by extremist groups.

So let's be clear about this: There is absolutely no legal or scientific basis for this lawsuit. Period.

Mifepristone is:

• incredibly safe and effective, with a 99% safety record
• used by millions for miscarriage and abortion care
• supported by decades of research

Banning the use of mifepristone would:

• disproportionately impact young people, people with lower incomes, and people of color
• exacerbate the growing maternal mortality crisis that has fallen hardest on Black women
• compound the public health crisis created when Roe was overturned

ACLU Supporter, there's zero justification for removing this medication from the market.

This is just an attempt by anti-abortion extremists to use their hand-picked judge to prevent doctors from prescribing an extremely safe medication that has been used for decades – and is the next step in a larger plan to ban abortion nationwide.

Keeping mifepristone accessible allows us to receive care on our own terms. Make no mistake, we at the ACLU will be acting swiftly and for the long haul the minute the decision comes down.
