In 2017 the California legislature adopted one of Sen. Scott Wiener's first major housing bills: SB 35. By accelerating the approval times for affordable housing projects, SB 35 has led to the streamlined approval of over 11,000 homes statewide, most of them subsidized homes affordable to low-income families.
Unfortunately, when SB 35 passed it included a sunset clause. That means it will expire on January 1, 2026 – unless the legislature acts to extend it.
Today California YIMBY stood with Sen. Wiener, affordable housing developers, construction workers, and other leaders to introduce SB 423. It will not only make the provisions of SB 35 permanent, it also expands them to create stronger incentives for mixed-income housing.

California needs to pull out all the stops to build as much housing as possible. SB 423 will turbo-charge the construction of mixed-income housing – just as SB 35 did for subsidized affordable housing.
SB 423 also includes provisions to ensure construction workers are fairly compensated for their work. After all, it's their labor that makes California more affordable.
SB 35 has helped provide more housing, including affordable housing, in communities across the state. A 2021 study by the San Francisco planning department found that, since its passage, the law has shortened approval times for affordable housing from as long as 3 years to just 4 months, and created nearly 2,000 homes just within city boundaries – 93 percent of them deed-restricted affordable units.
It's time to build on that success by making SB 35 permanent, and extending its benefits to mixed-income housing. We'll give builders the certainty they need to ramp up construction of housing for all Californians, while creating a pathway to grow our state’s pool of skilled homebuilders.
SB 423 could help address California's housing shortage and affordability crisis. But its passage is no sure thing.
