If anyone were to doubt how presidents shape our federal courts for generations to come, they need only look to Texas.

Trump appointee Matthew Kacsmaryk, District Court Judge for the Northern District of Texas, is poised to revoke the FDA’s approval of mifepristone, which is used in combination with misoprostol for medication abortion. If he does, an appeal would land in the Fifth Circuit Court of Appeals, potentially triggering another major abortion access fight at the Supreme Court.

Medication abortion accounts for the majority of abortions in the United States. Abortion pills are a safe and effective way to end an early pregnancy in the comfort of one’s own home, and they have become particularly crucial after Roe v. Wade was overturned.

However, an appeal to reason won’t stop anti-abortion extremists who are hellbent on cutting off abortion access in every way possible.

If Kacsmaryk rules against the FDA, it would send shockwaves across the entire country. Just because abortion is legal in certain states doesn’t mean methods of abortion are protected. We need those explicit protections—namely from the Dept. of Justice, which has been investigating legal avenues to retain access to medication abortion.
