Hi John,
VOTING RIGHTS CASE UPDATE!
Today, we received a cease and desist letter. It came from the attorney for Tom Baio, who is the losing Republican candidate for Mendham Township Committee seeking to overturn the election results; the Mendham Township Deputy Mayor Sarah Neibart; and Morris County Republican Chair Laura Ali.
It says that we made a false statement regarding the actions of Baio to prevent the winning Democratic candidate, Lauren Spirig, from taking office.
In the spirit of cooperation, we will replace our earlier statement with the verbatim language from Baio’s verified petition, filed on Dec. 21, 2022, and publicly available online.
The filing made the following demands:
“WHEREFORE, the Petitioner hereby demands judgment as follows:
1) Restraining Lauren Spirig from taking office as a member of the Mendham Township Committee pending further order of the court.
2) Invalidating the Certificate of Election of Lauren Spirig to the Mendham Township Committee.
3) Entering judgment that certifying [sic] Thomas Baio as the winner of one three-year term on the Mendham Township Committee.
Yes, Baio made these demands! However, they did not follow through with the court, and so a judgment was never rendered, and Lauren Spirig was sworn in on Jan. 5, 2023.
We hope this serves to clarify any miscommunication.
