NEW: Tracy McCarter's case has been dismissed!1 

New York Supreme Court Justice Diane J Kiesel issued the dismissal Dec. 2, two weeks after Manhattan District Attorney Alvin L. Bragg sent a letter stating that he could not allow prosecution of the case to go forward.

This is a MOMENTOUS victory for Tracy, her family, the community and all of those who rallied for her freedom. Abused by her estranged husband, Tracy was forced to fight for her life and had been facing criminal prosecution since her arrest in March 2020 for Murray’s murder.

John, it is because of you and the 21,000 Color Of Change members who signed the petition calling on DA Bragg to drop the charges against Tracy that we've achieved this victory. In partnership with Court Watch New York, Survived & Punished NY and Envision Freedom Fund, and with community organizers and activists, COC members ensured DA Bragg heard our demands. DA Bragg’s request to drop the case ultimately caused the judge to issue the dismissal. Tracy is now free to resume her life and career and thrive once again.

John, this is a demonstration of our collective power. You have the power to make prosecutors work for the people they are elected to serve — people like you.

TELL PROSECUTORS TO PRIORITIZE REPRODUCTIVE HEALTHCARE OVER INCARCERATION

John, we couldn’t have made it this far without your support. During the past six months, we’ve fought to elevate Tracy’s story, which is the reality of many criminalized Black survivors of intimate partner violence across the country.

Here’s how you’ve helped us #StandWithTracy. Together, we:

Launched a nationwide petition that garnered more than 21,000 signatures;
Released a full-page ad in The New York Times calling on DA Bragg to stop Tracy’s prosecution;
Produced videos highlighting Tracy’s story from the perspective of her loved ones and community members advocating for her freedom;
Collaborated with so.informed,2 a social media site dedicated to breaking down political issues, to educate a broader audience on Tracy’s case and the role of the DA in ensuring her freedom;
Hosted a petition delivery and rally event that drew coverage from local and national news outlets.
But right-wing opponents have made several attempts to discredit this win. Two conservative newspapers have claimed falsely that Bragg made his decision because of a “campaign donation,” tantamount to alleging political bribery by our movement.3 These are the dirty tricks that the right plays to undermine our victories. We need your help to fight back.

We can’t stop fighting now. Now more than ever, we need to keep the momentum going in our communities in Oklahoma.

We at Color Of Change applaud District Attorney Alvin Bragg for having the courage to halt Tracy’s prosecution. The legal system will never achieve justice for survivors when Black women are terrorized by violence, re-traumatized by their abusers, betrayed by police who are paid to protect and serve the public and then put on trial when they were merely trying to protect themselves. Bragg has shown tremendous leadership and taken an important first  step toward redefining safety for Black survivors of intimate partner violence and creating a system of accountability that puts people first.

John, join Color Of Change as we continue pushing for the freedom of other criminalized survivors and building a world in which we invest in communities, not the criminal legal system.
