“Joint employer” sounds like a pretty technical term. But if you’re a truck driver, a security guard, a custodian, or working in any number of jobs where you have more than one employer, you’ve probably heard of it.
“Joint employer” is the idea that two or more companies can share responsibility for the treatment of their workers. Designating firms that share control over a worker’s terms of employment as joint employers helps ensure that working people are treated fairly and that all companies responsible for violations of the law are held accountable.
Last year, together, we helped lead the national effort opposing the Trump administration’s proposed rule that would make it harder to prove that a firm is a joint employer and thus liable for its employees. EPI estimates this rule change will cost working people more than $1 billion annually due to wage suppression and wage theft.
Unfortunately, despite the submission of tens of thousands of comments and opposition from workers’ rights groups, the Trump administration just announced that it will go through with its rule weakening the joint-employer standard. This rule change will create an incentive for large corporations to outsource work to staffing companies or subcontractors and allow these corporations to escape responsibility under the Fair Labor Standards Act.
The change in the joint-employer rule is part of the Trump administration’s systematic undermining of workers’ rights and wages. We’re fighting back, demanding stronger labor unions, better pay and benefits, and stronger protections for working people.
