I’m thrilled to share the news that the Supreme Court will hear Tyler v. Hennepin County, stemming from a 94-year-old widow’s fight to end “home equity theft” in Minnesota and across the nation.

A home’s equity, often representing owners’ retirement and life savings, is property and just as protected by the Constitution as a home or land.

Yet many states allow local governments to keep the entire value of a home when collecting property tax debts—no matter how little the homeowner might owe. By our count, nearly $800 million in home equity has been stolen by governments between 2014 and 2021. In this case, county bureaucrats seized Geraldine Tyler’s condo, sold it, and kept 138% more than what she owed—leaving her with nothing.

PLF recognized this widespread, outrageous government tactic that has victimized citizens for decades and began challenging it in lower courts across the country. We’ve now elevated it to the national stage thanks to the relentlessness of our team and the principled courage of our client, Geraldine.

We look forward to defending liberty and justice for all before the highest court in the land for a third time this term, and our 19th time overall. We’re confident that liberty will prevail—bringing security and peace to untold numbers of future struggling homeowners and demonstrating to all Americans the importance of strong property rights.

Read the announcement and stay tuned for much more on this case in the months ahead.
