NFIB will be providing members of Congress with a pro-small business legislative agenda to kick off the 118th Congress. NFIBs 118th Congress Growth Agenda is based on the feedback collected from members as a guideline for the small business issues that warrant lawmakers' consideration.

The EPA issued a new Waters of the United States (WOTUS) rule, ignoring NFIBs call for the agency to wait while "Sackett v. EPA" is pending at the U.S. Supreme Court. This rule further complicates compliance standards and increases uncertainty for small businesses as they wait to hear from the Supreme Court.

A new IRS reporting requirement which would further complicate small businesses tax-related administrative burdens has been delayed by one year. The law requires payment processors such as PayPal and Venmo, as well as online marketplaces like Etsy and eBay, to issue a 1099-K federal tax form when a users annual gross sales total more than $600 in a year.

NFIBs One Member, One Vote system means that members vote their member ballots to inform NFIBs policy positions in state government advocacy.

The NFIB Research Center surveyed NFIB members in December on the impacts of COVID-19. Most small business owners report their local economy remains below pre-crisis levels of economic activity.
