The U.S. Constitution says the Chief Justice of the Supreme Court will preside over a Senate impeachment trial of the president, and the senators would try the case under oath.

The Senate Rules spell out the oath that senators must take in such an impeachment trial, where they pledge to render "impartial justice according to the constitution and the laws."

By that standard, three Republican senators cannot try an impeachment trial of Donald Trump. And if they were to take this oath, they would themselves be committing perjury.

Senate Majority Leader Mitch McConnell (R-KY) has openly admitted on television that he's not an impartial juror, and has even strategized behind closed doors with Donald Trump's legal time to map out the trial—with the desired outcome of his eventual acquittal.

Senator Lindsey Graham (R-SC) won't even pretend to be a "fair juror," and has said he wants impeachment to "die quickly" in the Senate with no witnesses.

Senator Ron Johnson (R-WI) is likely the most problematic juror. He was a witness in various incidents that relate to the underlying charges, and even personally confronted Donald Trump about whether he withheld foreign aid to the Ukraine. When the House held impeachment hearings, Republicans even formally asked Senator Johnson to weigh in on what he knew.

When the Senate starts the impeachment trial on Thursday, one of the first things Justice Roberts would have to do is swear in all 100 senators as jurors to try the case. It is at this crucial moment where he would have to determine if some senators are unfit to serve.
