Yesterday, the South Carolina Supreme Court blocked the state's six week ban on abortion, ensuring abortion is protected for all South Carolinians through the state’s constitutional guarantee to the right to privacy. The 3-2 decision is the first ruling by a state supreme court on the merits of an abortion ban since the U.S. Supreme Court overturned Roe v. Wade.
The ban had been blocked by federal courts since 2021, but took effect shortly after the U.S. Supreme Court overturned Roe. Today’s ruling permanently strikes down the ban, allowing doctors to continue providing abortion care to patients beyond the earliest stages of pregnancy in a region decimated by state abortion bans.
