In June, the conservative Supreme Court supermajority struck down a key Environmental Protection Agency (EPA) climate regulation and introduced a doctrine that will be used to challenge new environmental regulations for years to come. |
Next year, this Supreme Court will decide a case that threatens to rip apart the Clean Water Act and give polluters a free pass to dump toxic waste in wetlands and streams across the country. |
The Supreme Court is stacked against us, but we will not back down. In the Court’s upcoming Clean Water Act case, Sackett v. EPA, we have filed an amicus brief on behalf of 18 tribes fighting to protect waterways flowing through their lands. |

In West Virginia v. EPA, the Supreme Court went out of its way to prevent the EPA from using one highly effective method of regulating greenhouse gas emissions under the Clean Air Act. |
We were prepared, and quickly began to pressure the EPA to finalize a new suite of 10 rules based on its extensive remaining authority. Together, these 10 rules would work to reduce the carbon pollution that drives climate change, reduce the traditional air and water pollution that harms public health, and reduce environmental harm that is borne disproportionately by disadvantaged communities and people of color. |
And with Democratic control of the Senate, we will continue to push for rapid nominations of fair judges in the lower courts (which decide the vast majority of cases). |
Looking ahead to 2023, the Supreme Court’s conservatives have been asked to make a similarly extreme ruling and shrink the scope of the Clean Water Act in Sackett v. EPA. |
