Last week, my office argued in front of the United States Supreme Court as they considered Moore v. Harper – a case legal experts are calling the biggest threat to free and fair elections in our lifetime. It could have significant consequences not just for gerrymandering, but potentially for the 2024 presidential election.
North Carolina Republican lawmakers argued that our state’s Supreme Court lacks authority to act as a check on our GOP-held state legislature and their glaringly gerrymandered congressional maps because of a radical, fringe idea called the “Independent State Legislature Theory.”
This theory essentially says that state legislatures are the ultimate authority on federal elections, and it’s the same theory that some of Donald Trump’s allies used in 2020 to try and overturn the presidential election. It’s a theory I don’t believe has any basis in law – but it is at the core of the North Carolina GOP argument that their districts must be upheld.
Mark my words: If the Republicans win this case, other Republican state parties who control state legislatures across the country will not hesitate to use this ruling to strip millions of Americans of their right to fair elections.
