John, When it comes to our elections, there’s no room for error. Last month, Free Speech For People joined the National Election Defense Coalition (NEDC), the Pennsylvania-based Citizens for Better Elections (CBE), pro bono partner law firm Baker Hostetler, and individual Pennsylvania voters, to file a lawsuit against Pennsylvania Secretary of the Commonwealth Kathy Boockvar, alleging that the state’s use of ExpressVote XL voting machines by Election Systems & Software (ES&S) violates the state’s Election Code and the Pennsylvania Constitution. Dauphin County Commissioners listened. They voted to reject purchasing this insecure voting system in light of the machine’s chronicled failures. Now we are calling on the state to decertify the Expressvote XL and hope that other counties in Pennsylvania follow Dauphin County’s lead. The ExpressVote XL is showing its true colors. Northampton County is demanding a refund from ES&S following a series of incidents that led to a unanimous “vote of no confidence” from election commissioners. The ExpressVote XL machines used in the county’s 2019 elections failed to recognize straight-ticket votes and initially showed a judicial candidate winning by a statistically impossible margin. We are committed to free and fair elections with secure, verifiable, and reliable voting technology for every American. By employing ES&S ExpressVote XL voting machines, Pennsylvania places its voters at risk.
