A ruling in favor of the fringe, right-wing independent state legislature theory could end protections against partisan gerrymandering and voter suppression — and give state legislatures the ability to manipulate and subvert federal elections.

In the worst-case scenario, if the Court endorses this fringe theory, GOP-controlled state legislatures could pass laws giving themselves the authority to overturn election results and choose their own presidential electors, regardless of the will of the voters.
