Donald Trump lost the 2020 election, and Republicans know it.
But the insurrectionists who backed his attempted coup on January 6 with baseball bats and pipe bombs were part of a larger movement, one wielding a fringe right-wing legal scheme¹ that Republicans planted throughout the 2020 election cycle — the “Independent State Legislature Theory” (ISLT) — meant to flip the balance of power over who sets the rules in federal elections.
ISLT was the cornerstone of Trump’s more hardcore loyalists’ legal attempts to overturn the election.² At the time it didn’t work — because the theory didn’t have any serious institutional backing. However, by next summer the extreme right-wing justices controlling the stolen Court could lay the groundwork for Republican operatives to succeed where Trump failed and help to overturn the 2024 election.
You read that right: Republicans stole the Supreme Court, and now it could set the stage for them to steal the 2024 election.
That’s because later today the Supreme Court will hear arguments in Moore v. Harper, a case in which Republican lawmakers in North Carolina are asking the Court to legitimize this bogus right-wing scheme, which could give state legislatures across the country virtually unchecked power to determine how federal elections are run in their states.
Even though Moore v. Harper has been called the most important democracy case since our country’s founding, a recent Marquette Poll found that 70% of Americans haven’t heard enough to even have an opinion about Moore. With a decision coming down in this case by next summer, every minute counts. We need to make sure that every person who cares about the future of our democracy knows about Moore v.
