Representative Adriano Espaillat Introduces the Responsibility and Integrity in Security Clearance (RISC) Act

Espaillat Bill Aims to Prevent Presidential Abuse of Power by Prohibiting Family Members and Financial Associates of the President of the United States to Receive a Security Clearance Without Going Through Appropriate Channels and Vetting Process

WASHINGTON, DC -- Today, Representative Adriano Espaillat (NY-13) introduced the Responsibility and Integrity in Security Clearance (RISC) Act to further measures to counter Presidential abuse of power by preventing family members and financial associates of the President of the United States from receiving a security clearance without going through appropriate protocols or channels.

“Congress has a responsibility to conduct oversight over the executive branch, and the previous administration proved that we can never take for granted this responsibility or the implications it may have when overlooked,” said Rep. Espaillat. “We have witnessed how fragile democracy is around the world, including here at home during the January 6th insurrection. During the previous administration, several of the former President’s family members and associates were given unprecedented access to our nation’s secrets by bypassing appropriate security clearance channels and protocols. My bill advances our national security by closing this loophole and avoiding the associated risks that come with unqualified, unvetted, and unscrupulous persons gaining such access simply due to their proximity or relation with the President.”

The RISC Act prevents abuse of power in providing security clearances to family members and other financial associates of the President of the United States. The bill includes the following:

· The White House Chief of Staff must notify Congress if the President grants security access to a family member or financial associate against or before the recommendation of agencies like the FBI.

· Notification must be given in writing by Chief of Staff within five days of the individual or group receiving security clearance.

· Revokes security clearances given to family members or financial associates of the President against or before the recommendation of federal agencies like the FBI.

El proyecto de ley Espaillat tiene como objetivo prevenir el abuso de poder presidencial al prohibir que los familiares y asociados financieros del presidente de los Estados Unidos reciban una acreditación de seguridad sin pasar por los canales y procesos de investigación apropiados

WASHINGTON, DC – Hoy, el congresista Adriano Espaillat (NY-13) introdujo la Ley de Responsabilidad e Integridad en la Acreditación de Seguridad (RISC) para adoptar medidas adicionales para contrarrestar el abuso de poder presidencial al evitar que los familiares y asociados financieros del presidente de los Estados Unidos reciban una acreditación de seguridad sin pasar por los protocolos o canales adecuados.

“El Congreso tiene la responsabilidad de realizar la supervisión del poder ejecutivo, y la administración anterior demostró que nunca podemos dar por sentada esta responsabilidad o las implicaciones que puede tener cuando se pasa por alto”, dijo el Rep. Espaillat. “Hemos sido testigos de cuán frágil es la democracia en todo el mundo, incluso aquí en casa durante la insurrección del 6 de enero. Durante la administración anterior, a varios de los familiares y asociados del expresidente se les dio un acceso sin precedentes a los secretos de nuestra nación al permitírseles eludir los canales y protocolos de acreditación de seguridad apropiados. La Ley RISC previene el abuso de poder al otorgar acreditaciones de seguridad a familiares y otros asociados financieros del presidente de los Estados Unidos. El proyecto de ley incluye lo siguiente:

· El Jefe de Gabinete de la Casa Blanca debe notificar al Congreso si el presidente otorga acceso de seguridad a un miembro de la familia o asociado financiero en contra o antes de la recomendación de agencias como el FBI.

· La notificación debe ser dada por escrito por el Jefe de Gabinete dentro de los cinco días de que la persona o grupo reciba la acreditación de seguridad.

· Revoca acreditaciones de seguridad otorgadas a miembros de la familia o asociados financieros del presidente en contra o antes de la recomendación de agencias federales como el FBI.
