WILL Challenges Unlawful Rules Which Create Barriers for Students in the Parental Choice Program

On behalf of School Choice Wisconsin Action, Inc., Catholic Memorial High School of Waukesha, Inc., and Roncalli Catholic Schools, Inc., WILL filed a lawsuit against the Wisconsin Department of Public Instruction (DPI) and Superintendent of Public Instruction, Jill Underly. The suit challenges several of DPI’s rules which were not promulgated in compliance with statutory rulemaking procedures, and which exceed the DPI’s authority as set forth in state law.

🗯 WILL Associate Counsel, Cory Brewer, stated, “DPI is exceeding its authority under state law in how it administers the Parental Choice Program and must be held accountable. The program was designed to be an easy-to-use option for parents, and DPI’s unilateral implementation of additional requirements constitutes unlawful bureaucratic overreach.”

WILL Continues to Hold the Wisconsin Elections Commission Accountable on Unlawful Absentee Ballot Collection

WILL filed an appeal against the City Clerk of Racine, arguing that the utilization of mobile voting sites throughout the community violates Wisconsin state law governing alternate absentee ballot sites. The City of Racine utilized an unlawful mobile voting van in both the primary and general elections this year to conduct in-person absentee voting.

🗯 WILL Deputy Counsel, Anthony LoCoco, said, “Racine’s abuse of alternate absentee ballot sites circumvents multiple statutory safeguards on the collection of absentee ballots. The WEC Commissioners failed to take action and delegated the matter to the WEC Administrator who declined to enjoin Racine’s illegal behavior. Further, although WILL’s complaint was filed in August, the WEC Administrator did not issue her decision on the matter until in-person absentee voting for the 2022 general election was essentially completed which meant that WILL could not appeal the decision until after the November general election was over. We are confident that a court will put an end to Racine’s egregious practices.”

WILL Research Director, Will Flanders, PhD, was interviewed on Spectrum News 1 Wisconsin. He discussed the new Healthcare Transparency Report and told reporter Anthony DaBruzzi, “When you go to get gas, you can see the gas price right there... Why should it be different than getting gas or getting groceries when you go for very important health care services?”

WILL partnered up with Scott Niederjohn and Mark Schug, professors who have spent their careers crafting social studies curriculum and training teachers, for a policy report that explained how academic theories impact student learning of social studies.

The authors recently wrote in The Washington Times, "Smith’s invisible hand and market competition were a big help to Robinson and Rickey in ending racial discrimination in MLB. This is a much more hopeful message about markets and race than is often emphasized in today’s polarized nation. If teachers brought lessons like this into the classroom, they could bridge racial barriers and bring students together."
