Whitehead is an experienced trial attorney and has spent time both in public service and private practice. He is an expert in employment law and workers’ rights and has represented victims of workplace discrimination, retaliation, and other unfair labor practices in both individual and class action cases.

Whitehead’s even-handed approach to employment law will be an asset on the federal bench. His case history demonstrates that no matter who or which side he is representing, he will seek the most equitable outcome. In a judiciary where corporate lawyers are historically overrepresented at the expense of workers’ rights and justice, this nomination is refreshing.

In addition to his excellent professional qualifications, Whitehead brings important lived experience to the bench as a Black person with a disability. Whitehead is the first disabled person President Biden has nominated to the federal judiciary and would join only a few current judges who also openly identify as disabled.
