Hi, Yet another scandal has hit the U.S. Supreme Court, this time potentially implicating Sam Alito, author of the decision overturning Roe v. Wade. A whistleblower and former anti-abortion activist has just come forward to reveal that an advance copy of the Supreme Court's landmark 2014 Hobby Lobby decision was leaked to him weeks before the decision was announced to the public — just like the opinion overturning Roe was leaked in advance.1 Both decisions were huge victories for the anti-abortion movement. Both decisions were leaked. And both were written by Justice Sam Alito, raising serious questions about whether Alito himself or someone close to him was the source of the leaks. The public credibility of the Supreme Court was already in free-fall, and this new scandal will only tarnish the Court's image further. That's why Demand Progress Action is calling on Congress to immediately take action to clean up the Court by passing the Judicial Ethics and Anti-Corruption Act, which could finally force the Supreme Court to adopt a code of ethics.
The Supreme Court is the most powerful and least accountable branch of the federal government. The nine justices are appointed for life, and despite their virtually unchecked power, there are no rules regarding when they must recuse themselves or even reveal potential conflicts of interest.2 No wonder that public confidence in the Supreme Court in particular is at an all-time low.3 Chief Justice John Roberts called the leak of the decision overturning Roe v. Wade a "betrayal of the confidences of the court" and took the unusual step of ordering an investigation by the marshal of the Supreme Court.4 But despite years of promising to "study" whether the Supreme Court should adopt a code of ethics, Roberts has refused to follow through.5 This latest scandal could finally be the last straw, convincing Congress to step up and enact a Supreme Court code of ethics for them. But that will only happen if we can mobilize enough public support to demand that Congress take action.
