Happy New Year! We hope everyone had a relaxing, joyful break with friends and family. At CLASP and NILC, we are feeling well-rested and hopeful for what we can accomplish together in the year ahead. Below is a brief update on what’s happening with litigation efforts. For a deeper dive on public charge and related policies, as well as best-practices for community-based organizations, we’d love to have you join us for one or more of our webinars and calls this month. LITIGATION UPDATE
Over the holidays, we have seen some movement on the public charge and the health insurance proclamation litigation, and there are a couple hearings scheduled this week.
- DHS Rule Still Blocked. Up Next: Hearing on January 7
As a reminder, five federal courts issued preliminary injunctions halting the DHS public charge rule from taking effect. Two federal appellate courts have since lifted the injunctions, but the nationwide injunctions issued by a court in New York and an Illinois- specific injunction remain in effect. All of these decisions are subject to review by the appellate courts. The legal fight will continue, but for now, the longstanding public charge policy that governs decisions made by immigration officials inside the U.S. remains in place. Help us pack the courthouse! Tomorrow at 10:00am ET at the Thurgood Marshall Courthouse. The 2nd Circuit will hold a hearing on Tuesday, January 7 on the federal government’s motion to lift the New York district court’s nationwide preliminary injunctions. The New York Immigration Coalition (NYIC) is organizing allies to pack the courtroom to show solidarity and concern about the effect of the rule if it is allowed to go into effect. - Health Insurance Proclamation Still Blocked. Up Next: Hearing on January 9
The Health Insurance Proclamation, signed by President Trump on October 4, 2019, would restrict immigration to the U.S. by people who cannot show that they will be able to buy “acceptable” health coverage (which does not include subsidized ACA coverage) or that they have an unspecified level of resources to cover their potential health care costs. The 9th Circuit will hold a hearing on Thursday, January 9 on the federal government’s motion to lift the Oregon district court’s nationwide preliminary injunction. The case was brought by PIF friends at the American Immigration Lawyers Association (AILA) as well as others.

Public charge is an issue that cuts across many sectors and has caused many organizations to stretch outside their normal areas of expertise. Join us to hear from immigrant-serving organizations from across the country share their experiences and expertise in building an effective public charge campaign in their own communities. The best practices highlighted in this webinar are the start of many years of work ahead to support threatened immigrant communities, and they will undoubtedly be adapted, evolved, and reinvented in the years to come.

STATE OF PLAY CALL

PUBLIC CHARGE 101 WEBINAR
January 30 at 3pm ET, 12pm PT
Do you or your colleagues need a refresher or a first time overview of how the public charge test works today in the U.S. and abroad, and how it may change in the future? If so, please join us for our first Public Charge 101 webinar of 2020. Experts from NILC and CLASP will describe the different public charge policies currently in place, discuss how and when they may change, and explain what you need to know if you work with immigrant families. We will also cover how you can take action and get more involved with the work of the Protecting Immigrant Families Campaign.
