We know elections have consequences, and in Mississippi, the results include losing the ability to bypass the state legislature and place a measure on the ballot.
Today, Mississippi has the dubious distinction of being the only state in modern history to rescind the ballot measure process.
Mississippi voters are denied this fundamental right because of the actions of two elected bodies: the state legislature and the state supreme court.
In 2021, the state supreme court ruled the ballot measure signature-gathering process in Mississippi unconstitutional. The court’s ruling came after voters approved a medical marijuana ballot measure in 2020.
With its decision, the court invalidated the entire ballot measure process, thereby denying voters the right to place any measures on the ballot moving forward.
Following the court’s decision, the majority-conservative state legislature stalled on passing new legislative language during its 2022 session to restore the ballot measure process.
The action by the state supreme court and the failure to act by the state legislature are attacks on direct democracy in Mississippi.
Our team at the Fairness Project alongside local advocacy groups have been calling for state politicians to restore the fundamental right of direct democracy to Mississippi voters. We’re quietly optimistic that, in its 2023 session, the state legislature will reinstate ballot measures.
