Subject IJ Victory: You don’t need to be a real estate broker to list a home on Airbnb

This morning, I called IJ client Sally Ladd with news she has been waiting more than five years to hear: She can now legally operate her business after IJ secured a major victory for her and for economic liberty in court. <[link removed]>

Since the summer of 2017, Sally has been under investigation for the “unlicensed practice of real estate” in Pennsylvania. The commonwealth insisted that she would need to spend three years working for an established broker, pass two exams, and set up her own brick-and-mortar office in Pennsylvania.

But Sally’s business is simple. She works from her home helping people list short-term vacation rentals online through sites like Airbnb. She doesn’t buy or sell homes, and she doesn’t need to invest years and hundreds of thousands of dollars on a complicated and irrelevant license.

This morning, the court agreed, declaring the requirements “unreasonable, unduly oppressive, and patently beyond the necessities of the case.” The court also held that forcing Sally to comply “in no way advances the [government’s] goal of public protection.”

This success follows in the footsteps of IJ’s landmark victories at the Texas and Pennsylvania Supreme Courts, which established heightened protections for the right to earn an honest living. We are poised to continue that momentum in Georgia next year, and IJ will not rest until all Americans are free to work in the occupation of their choice.
