As of today, Democracy Docket tracked 157 lawsuits filed in 2022 across 34 states. 96 of these lawsuits are currently active and ongoing. Of the active lawsuits, 38 seek to restrict access to voting.

Here are some updates from today.

A federal judge issued a decision allowing Clean Elections USA to continue monitoring drop boxes, ruling that prohibiting its plans would violate First Amendment rights even if voters are “legitimately alarmed by the observers.” The decision has been appealed.

Michigan Secretary of State Jocelyn Benson (D) and the state’s director for the Bureau of Investigations filed an emergency appeal in the Michigan Supreme Court asking to keep new rules regulating election challengers. [link removed] A lower court found that Benson lacked the authority to make new rules. [link removed]

Yesterday, Nevada Secretary of State Barbara Cegavske (R) sent a letter to Nye County telling the county commissioner that the “current Nye County hand counting process must cease immediately.” [link removed]

The Arizona Court of Appeals scheduled oral argument in a Republican lawsuit seeking to strike down the state's 1991 no-excuse mail-in voting law for Dec. 7, 2022, notably after the midterm elections. [link removed]
